The High Court of England and Wales has approved the service of documents relating to bringing the substance of the claim to the attention of the defendant via NFT. This was reported by the law firm Giambrone & Partners.

Giambrone & Partners represents the interests of Fabrizio D’Aloy, founder of the gambling company Microgame. The latter sued five cryptocurrency exchanges (Binance, Poloniex, Gate.io, OKX, and Butkub) and a group of unknown individuals for confiscating their digital assets.

“The allegation concerns the embezzlement of Mr D’Aloy’s cryptocurrency by unknown individuals who run a clone of fake online brokers that encourage investors to deposit their assets into two wallets,” the company said. Declaration.

The court ruled that the delivery of the case could be accomplished by transferring the relevant NFTs to the cryptocurrency wallets that D’Aloy had lost control of. According to lawyers, this allows for proceedings to be initiated even if the identity of the alleged defendant has not been established.

“This decision opens the possibility for other victims of the scam to prosecute unknown individuals who embezzled their cryptocurrencies when they could not otherwise. For example, when the contact information of the rogue platform is no longer relevant,” said Giambrone & Partners.

The company has also taken a decision making bitcoin exchanges liable for locking misused client assets on their systems.
