The U.S. Chamber of Commerce held a series of sessions where experts from academia, industry, and government addressed the issues that hinder the development of modern AI models. These include the patentability of algorithms and the requirement to copyright machine-made inventions.
According to those who attended the hearings, current legislation on intellectual property has not changed much since it was adopted in 1793. Experts say that despite the broad category of patentable inventions, registration of machine learning models is still difficult.
As an example, they cited challenges with reproducibility and limited access to training data. Therefore, patent registrants may reject applications if they find the text to be confusing or uninterpretable.
Experts insist on the need to change the law so that machine learning systems can be considered new inventions.

According to him, modernization of patent law is necessary to commercialize algorithms and accelerate innovation.
“This is an absolutely necessary and urgent matter of national security,” Iancu said.
Panelists also noted China’s leadership in the number of patent applications for artificial intelligence systems in 2019 and 2020.
Most experts agreed that the intellectual property rights of AI models should be registered. However, it is debatable whether to give authorship or ownership to technology producing machines.
Recall that in February the USPTO rejected an application to register the intellectual property of an art object created by a machine learning algorithm.
In June, the inventor requested the court to patent the painting created by the AI model.
That same month, Australian researchers urged the global community to pass copyright law for algorithms.
