The adults are coming Changes in Telcel (and also on Telmex). Or at least that’s the intention of the Federal Communications Institute, which has approved a series of new regulatory measures reaching América Móviles operators in Mexico.

As our colleagues at Xataka México point out, the new guidelines aim to encourage competition between companies and therefore provide greater benefits to users. Let’s see what the new settings are.

What will change in Telcel with the new regulations?

Unlocking terminal equipment. The operator must deliver all its terminals unlocked. It does not matter whether you purchase a prepaid or postpaid device here, because the measure will apply equally to all customers.

The idea is that users do not need to change equipment when they want to switch to another operator. There is also the possibility of choosing another provider by requesting the unlocking of the equipment in question, but the need to perform this procedure will disappear.

Say goodbye to mandatory deadlines. The operator is now prohibited from setting mandatory deadlines or minimum deadlines in telecommunications service contracts. This is a measure that affects both phone and internet services.

An important point is that this rule applies to normal users. Those who are corporate customers will be able to continue their contracting services on permanent terms.

Conditions are now prohibited. The operator will no longer be able to condition the purchase of equipment and services. IFT explains that this measure strengthens the previous measure on separating contracts for telecommunications services and terminals.

Latest for certain portability strategies. The operator will not be able to contact users who decide to switch to another provider, using the portability advantage to keep their number for 60 days after the change is made.

When will the new measures imposed by IFT come into effect?

The publication of the decision containing the new measures does not mean that the operators (in this case Telcel and Telmex) have implemented these measures. changes immediately. IFT usually provides a grace period before changes can be implemented.

In the past, this was six months, so that’s a good benchmark to keep in mind. However, there is one piece of information that should not be overlooked: Operators may also reject these measures, which may delay compliance.

América Móvil decided to appeal the measures implemented by the IFT.

As reported by DPL News, América Móvil has decided to appeal the measures implemented by IFT. The group behind Telcel and Telmex said the organization did not take into account changes that have been implemented more than 10 years since the “asymmetric measures” were introduced.

Talk of asymmetric measures is not new in Mexico. This special compliance regime came into being in 2014 and has since updating regularly through various IFT decisions, decisions like the one we saw this week.

América Móvil, led by billionaire Carlos Slim, overwhelmingly dominates the telecommunications market. According to Statista, as of March 2024, Telcel controlled 65% of the mobile phone market in Mexico, surpassing Movistar, AT&T and others.
