Electronics maker Apple is on a legal crusade in several countries to secure trademark rights for apple logos.
This peculiar situation was described in the report wired, which found a specific registration case in Switzerland. A Les Fruit Suissesa company that has been growing, harvesting and distributing food for 111 years now feels threatened by a possible lawsuit and could lose its traditional brand.
According to the website, the company produced “multiple requests” on the intellectual property of the apple design, which would allow the person responsible for the iPhone to be placed as the owner of images of apples in the logos of companies and institutions – not only in a bitten form and with a missing piece, like her symbol, but as a whole represents the fruit. A Swiss company, for example, has a red all-fruit logo with a white cross in the right corner representing the country’s flag.
legal list
The symbol of an apple with a leaf on top and a missing part has been appearing on the company’s electronics since 1977, created by designer Rob Janoff. In the initial version, it had several colors and even accompanied the company name.
Countries such as Japan, Turkey, Israel and Armenia have already dealt with similar cases, with the main use of the brand even being transferred to the manufacturer, but only when using electronics, digital products or other consumer products in the technology sector.
In other cases, however, there is no division as to which sectors are covered by the registration, meaning that the company will own the black and white image of the apple anyway. In Switzerland, the company has been trying to register a logo since 2017 granny smith apple (better known here as the green apple) without the characteristic bite.
Originally responsible for copyright and trademark matters in Switzerland “partially secured” using the Apple logo for Apple, but only for certain product categories. Company filed an appeal in April 2023. and is awaiting sentencing, but is likely to meet resistance when trying to register the rights to what Fruit Union Suisse believes “something almost universal” like a picture of the world famous fruit.
Wanted by Wired, Apple has not officially commented on the case.
