A federal judge ruled on Wednesday that Donald Trump Responsible for denigrate writer E. Jean Carroll denying in 2019 that he raped her and said the jury would only decide how much the former president USA for damage.
Judgment by a federal district judge Lewis Kaplan in Manhattan precedes a civil trial set for January 15, 2024, after a jury ordered Trump to pay Carroll in May $5 million To sexual abuse and a separate libel case.
The jury “reviewed and decided issues that are common to both cases,” and their verdict and undeniable facts “confirm that Mr. Trump’s statements in 2019 were made with genuine malicious intent,” Kaplan wrote.
Trump is appealing the May 9 jury verdict, as well as Kaplan’s June 29 refusal to dismiss the current lawsuit, to the U.S. Court of Appeals for the 2nd Circuit in Manhattan.
He also separately pleaded not guilty to four separate federal and state criminal charges, including two charges of trying to undo his defeat in the 2020 election.
Despite the allegations, Trump, 77, has a decisive lead in the 2024 Republican presidential nomination.
Carroll, 79, former magazine columnist. Elle seeks an additional $10 million for Trump’s June 2019 statements in which he denies he raped her in a department store dressing room Bergdorf Goodman in Manhattan in the mid-1990s.
Trump stated that he never met Carroll and that she fabricated the attack to boost sales of her memoirs, stating that they “should be sold in the fiction section” and that it was “an absolute shame that she is allowed to do that.”
In his 25-page decision, Kaplan said the May 9 jury verdict eliminated the need to reconsider the alleged attack.
Kaplan also said the verdict made it impossible for Trump to argue that his statements in June 2019, which were similar to his statements in October 2022, were not defamatory.
The judge also dismissed Trump’s contention that the previous verdict meant that any damages should be reduced because Carroll should not receive reparations twice.
Carroll claimed that the first slander against Trump did him more harm, including his reputation, than the second.
Roberta Kaplan Carroll’s lawyer said she was looking forward to the trial, which will take place on January 15. She and the judge are not related.
On August 18, Judge Kaplan called Trump’s appeal of his decision to take the second case to trial “frivolous.”
This could result in Trump having to pay Carroll damages and costs if the appeals court agrees.
In a June 2019 speech, Trump also disparaged Carroll, stating “she’s not my type” and that the alleged rape “never happened”.
The judge did not rule on whether the comments were defamatory, stating in a footnote that neither party properly answered whether they should rule before the trial.
