Judge David Ezra of the Western District of Texas noted in his ruling that the 300-meter barrier constitutes an “obstruction of navigational ability” Rio Grande and reprimanded the Republican state government for not requesting federal clearance before installing it.

In turn, Ezra found that the state government did not provide “any credible evidence that the buoy barrier significantly reduced” illegal migration through the Rio Grande and that, in addition, poses a “threat” to people’s lives trying to cross the border.
