The kid watched the movie on Netflix using an iPhone and AirPods Pro. At some point, the system warning went away yellow alert (hijacking warning system). At first, the headphones worked at low volume, but Amber Alert’s volume was so loud it ruptured the baby’s eardrums and damaged the cochlea. After the incident, the boy suffered from hearing loss, nausea, dizziness, and tinnitus. Now she needs to wear a hearing aid.
This actually happened in 2020, but as often happens, the masses will learn about such events much later. The lawsuit claims that Apple is aware of “defective” AirPods that do not drown out the sound of Amber Alerts. In addition, Apple did not warn about a possible problem that users may encounter.
The lawsuit against Apple seeks compensation for the child and his parents who experienced great emotional stress as a result of the situation. The lawsuit calls for “punitive damages in an amount that will punish the defendants for their behavior and deter other tech companies from engaging in such misconduct in the future.”
