During the negotiations, we agreed on a paradigm shift in drug policy regarding cannabis, openly recognizing social reality.

The legalization of cannabis is part of the government coalition agreement made up of the three aforementioned parties. In principle, it is planned that this drug will be removed from the list of prohibited substances of the Narcotic Drugs Act. However, it still must be approved by the German parliament.

Under pressure from the Greens and Liberals, the government coalition parties agreed to less stringent rules for the possession and consumption of cannabis than originally planned.

Consequently, the amount allowed for home cultivation will double – from 25 to 50 grams. Likewise, the prohibited consumption zone near kindergartens, playgrounds and schools will be reduced from 200 to 100 meters.

Expected fines will also be reduced. If possession limits are slightly exceeded, criminal prosecution will not be pursued, as explained by the head of health of Los Verdes Kirsten Cappert-Gonter.

Initially, possession of more than 25 grams was considered a crime. It will now range from 25 to 30 grams in public spaces and 50 to 60 grams in private spaces. Possession will only be considered a crime with possible jail time if it exceeds this amount.

The sale of marijuana is still prohibited and driving limit remains at the analysis stage. The Ministry of Transport will propose a THC limit by the end of March.

THC is the active ingredient in the cannabis plant. It was announced that the current blanket ban on driving under the influence of cannabis would be replaced by a rule that, like alcohol, sets a limit for THC levels in the blood.
