A U.S. judge has rejected Texas’ attempt to block federal immigration authorities from tearing down razor wire the state had installed along its border with Mexico to prevent migrants from crossing.
District Judge Aaliyah Moses, based in Del Rio, Texas, criticized President Joe Biden’s government in a written order for its “absolute failure” to prevent illegal entry into the country.
He said Texas is unlikely to succeed in its claims that the federal fence removal policy is outlawed.

The accordion wire fence was installed on private property along the Rio Grande River by the Texas National Guard as part of Operation Lone Star, an initiative launched by Republican Gov. Greg Abbott in 2021 to prevent undocumented migrants from crossing the border.
Paxton’s lawsuit alleges that U.S. Customs and Border Protection agents have recently intensified an existing practice of cutting, destroying or otherwise damaging fencing that the government has strategically installed with the permission of landowners.
The Republican prosecutor stressed that although Texas’ lawsuit was dismissed, the judge “found no merit” in the Biden administration’s arguments that Texas’ chain-link fence interfered with the Border Patrol’s ability to carry out its duties or respond to medical emergencies. EFE
At the Biden administration’s request, a federal judge ordered the 1,000-foot barrier removed in September, but an appeals court allowed it to remain in place temporarily while Paxton’s office appealed. (Reuters and EFE)
