Apple objected to the International Trade Commission’s (ITC) decision to ban the sale of Watch Series 9 and Watch Ultra 2 smart watches in the USA. Additionally, the company wants the ban to be immediately postponed for at least two weeks. Banned versions of redesigned models are being decided upon. Sales of the watch in the US were banned by the ITC, which ruled that Apple had infringed a patent held by medical company Masimo on blood oxygen measurement technology.

According to Apple’s lawyers, US Customs and Border Protection has until January 13, 2024 to decide whether to allow the release of updated versions of these smartwatch models.

The ministry’s ban does not affect the budget Apple Watch SE model currently on sale, as well as previously delivered devices. Retailers have the right to sell existing stocks of specified Apple smartwatch models but cannot import new ones.

According to Masimo, Apple tricked its employees, stole pulse oximeter technology and implemented it into a popular smartwatch. Apple countered Masimo in federal court in Delaware, calling its rival’s effort “a ploy to pave the way” for its own smartwatch.
