Michigan Supreme Court rejects Trump’s 2024 election disqualification

He Michigan Supreme Court This Wednesday he refused to disqualify the former US President Donald Trump (2017-2021), pre-candidate for the 2024 elections, from elections to White House for his role in the attack on Capitol from January 6, 2021

The decision in Michigan contrasts with a decision last week by the state Supreme Court. Colorado, it did disqualify Trump for elections 2024 on the same legal premise.

The plaintiffs, on whose side Colorado made an unprecedented decision, appealed the 14th Amendment to Constitution, which prohibits people who took part in the uprising from holding elected office.

This amendment was approved in 1868, after Civil War V USAto prevent people associated with the southern Confederate rebels from coming to power.

Unlike Colorado, judges in Michigan said the case raised a political issue that should not be decided by a court and dismissed the lawsuit without even holding a trial.

For now, these decisions only affect Colorado and Michigan because in the U.S. federal system, each state, not the nation, is responsible for administering elections. Courts in Mountain They also dismissed a similar case.

Trump’s presidential campaign announced in the wake of the Colorado decision its intention to go to the U.S. Supreme Court to ensure the former president appears on the ballot in every state in the country.

“We have every confidence that the Supreme Court will quickly rule in our favor,” spokesman Stephen Chung said.

The motion would leave in the hands of the Supreme Court – if it decides to accept the appeal – the final decision on whether the 14th Amendment can be invoked in Trump’s case and whether he can run in the 2024 presidential election.

Six of the high court’s nine members are considered conservative, three of whom were appointed by Trump himself during his term.

Republican primaries will begin on January 15 next year with caucuses. Iowa and Trump, according to all polls, is the favorite to once again meet with the current Democratic president Joe Bidenin the November White House elections.
