Google agreed to pay $5 billion in a lawsuit filed alleging that it secretly tracked users’ activities even in incognito mode.

The class action was scheduled to go to trial in February 2024, but District Judge Yvonne Gonzalez Rogers in Oakland, California, postponed the case after Google’s lawyers and consumers said they had reached a preliminary agreement.

The lawsuit demanded at least $5 billion in compensation. Terms of the settlement were not disclosed, but lawyers said they agreed to a binding list of terms through mediation and expect a formal agreement to be approved by the court by Feb. 24, 2024.

The plaintiffs alleged that Google’s analytics, cookies and applications allowed the Alphabet unit to track their activities even when they used Google Chrome in “incognito” mode and other browsers in “private” browsing mode.

They say this turns Google into “an inexplicable source of information” and allows the company to learn about their friends, hobbies, favorite foods, shopping habits and “potentially embarrassing things” they search for online.

The lawsuit against Google was filed in 2020 and demands compensation of at least $5,000 per victim for violations of the law.

As reported by Ukrinform, Google-owned Alphabet has agreed to pay $700 million and increase competition in the Google Play app store in accordance with the terms of an antitrust agreement with American states and consumers.
