Donald Trump has filed an appeal to the state court Maine What cancellation Secretary of State Shanna Bellows’ decision exclude him from the primaries at the state level of the Republican Party ahead of the 2024 presidential election for his role in storming the Capitol.
The former president’s lawyers argued that Bellows is a “biased legislator” who lacks the legal authority to make such decisions from her office, despite the fact that she holds a major constituency position in the state and that she was not given the “time” and adequate opportunity for guard”.
In addition, Trump indicated that the secretary of state “failed to provide due process of law” and that “she committed “multiple legal errors” by acting arbitrarily and capriciously.”
Moreover, he denied that he “participated” in the “rebellion” as claimed by government authorities.
The tycoon’s campaign spokesman, Stephen Chung, said Bellows “exceeded his authority.”
“He completely disregarded the Constitution when he decided to remove Trump’s name from the ballot, interfere in the election and disenfranchise voters in his state,” The Hill reports.
Likewise, he believed that the secretary of state “is a partisan Democrat” who “decided” to use her position “to help her preferred candidate, the corrupt Joe Biden” in the 2024 election.
“Trump will fight these bad faith attempts to destroy American democracy and hopes of victory both in the courts and in the presidential election,” he added.
Maine last week became the second state to exclude Trump from the state’s primary under the protection of the Fourteenth Amendment, which bars anyone who took an oath to the Constitution and participated in insurrection from ever holding public office again.
“I did not come to this conclusion easily. Democracy is sacred. I know that no Secretary of State has ever denied a presidential candidate access to the polls under Section Three of the Fourteenth Amendment.
“However, I also know that no presidential candidate has ever participated in an insurrection before,” he said at the time.
However, the issue is expected to have to be decided by the US Supreme Court, as other states – such as Michigan and Minnesota – have rejected this position.
Before Maine, it was the Colorado Supreme Court that issued a surprise ruling throwing the Republican out of the election. (Europe Press)
