A team of Israeli lawyers called this Friday South Africa’s ‘amazing’ petition to the International Court of Justice (ICJ) introduce precautionary measures against Israel that include an “immediate suspension of military activities” in the Gaza Strip, and assured that this would give the “other side” to the conflict “the freedom to continue their attacks.”

Attorney Christopher Staker said that “this request is, frankly, surprising” and explained that “a state that is not a party to the conflict is making a request for precautionary measures that require a unilateral suspension of military operations by one party to the conflict.” leaving the other side free to continue attacks.”

In addition, he warned that “the image that South Africa presented yesterday regarding the war in Gaza consists of “several isolated incidents”that “they are not evidence of the intent of the military operation as a whole,” in a dismissal of the “genocide” charge leveled by the South African team yesterday.

“Precautions must have their limits”the lawyer said, emphasizing that these instruments cannot “require that the state refrain from exercising a plausible right of self-defense,” and recalled that Hamas is considered a “terrorist group” in several countries and there is “no doubt” that its fighters have committed crimes in Israel “large-scale terrorist attack.”

The lawyer noted that the precautions “will not allow Israel to defend itself”; “they will put an end to attempts to rescue the hostages”; and “will enable Hamas to maintain its capabilities, allowing it to pose an even greater risk.”

He also called on the International Court to take into account in its verdict that Israel is “committed to respecting international humanitarian law” and is “taking measures to alleviate the humanitarian situation” in the Gaza Strip.

On the other hand, Israel’s representative to the International Court of Justice, Gilad Noam, stated that the Court does not have “jurisdiction” to rule on this provision, and reiterated that the precautions requested by South Africa would be “unjustified and prejudicial” to Israel.

Today, lawyers representing Israel had their turn to present their full case against the crimes listed yesterday by Pretoria, which accused Israel of violating the Genocide Convention1948, with the offensive in the Gaza Strip.

South Africa also called for precautionary measures, including “an immediate suspension of Israeli military operations in and against the Gaza Strip” to prevent Israel from continuing to “violate” the Genocide Convention, the treaty at the center of the case.

More than 23,400 people have died in the nearly 100 days of Israel’s war in Gaza, in addition to the nearly 8,000 bodies estimated to be trapped in the rubble.

In addition, more than 10,000 minors have died in the Gaza Strip in just three months of a brutal Israeli military offensive, and thousands more are missing, believed to be buried under the rubble, Save the Children said today.
