The US Supreme Court allows the removal of razor wire on the Texas border

The U.S. Supreme Court has temporarily allowed Border Patrol agents to cut or remove razor wire fences that Texas authorities have installed along the border with Mexico to prevent illegal border crossings.

The justices, in a 5-4 decision, granted President Joe Biden’s administration’s request to overturn a lower court ruling that temporarily barred federal agents from touching the fence while litigation over the matter continues.

Two conservative justices—Chief Justice John Roberts and Justice Amy Coney Barrett—joined the three liberal justices in the majority, with conservatives Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh dissenting.

The New Orleans-based 5th U.S. Circuit Court of Appeals, which issued the controversial temporary ruling, is scheduled to hear arguments Feb. 7 on whether Border Patrol agents violated Texas law by cutting the razor wire barrier.

This immunity protects the federal government from civil suits and criminal proceedings.

Texas sued the administration in October 2023 over what it said were U.S. Customs and Border Protection agents’ increased practice of cutting, destroying or otherwise damaging fences that the state had strategically placed on private land with the owners’ permission.

Republicans have sharply criticized Biden’s immigration policies and the spate of illegal entries across the U.S. border with Mexico. The problem is sure to intensify ahead of the Nov. 5 election, in which the Democratic president seeks to remain in office for another four years. (Reuters).
