On Tuesday, South Africa called on the International Court of Justice (ICJ) to issue a non-binding legal opinion that declare Israeli occupation of Palestinian territories illegalarguing that this would advance efforts to reach an agreement.

South African representatives opened the second day of hearings at the International Court of Justice in The Hague, Netherlands. Hearings are held at the request of the UN General Assembly advisory, non-binding opinion, about the occupation in 2022. More than 50 states will present their arguments by February 26.

Palestinian officials asked the UN’s top court on Monday to declare Israel’s occupation of their territory illegal, saying the court’s advisory opinion could promote a two-state solution and lasting peace.

Israel is not present at the hearings but has submitted a written statement that the advisory opinion will be detrimental to achieving a negotiated settlement with the Palestinians.

A panel of 15 judges of the International Court of Justice was asked to consider “occupation, settlements and annexation (…) Israel, including measures aimed at changing the demographic composition, character and status of the Holy City of Jerusalem, as well as the adoption of related discriminatory laws and measures.”

Judges are expected to take about six months to rule on the application, which also asks them to examine the legal status of the occupation and its consequences.
