U.S. Supreme Court Justice Samuel Alito on Monday extended a temporary stay of a Republican-backed Texas law that allows state authorities to arrest people suspected of illegally crossing the border with Mexico.
Alito’s decision gives the justices more time to weigh President Joe Biden’s administration’s request to freeze a court order allowing the Texas law to take effect while his challenge plays out in lower courts.
The administration said the Texas measure violates the U.S. Constitution and federal law by interfering with the U.S. government’s authority to regulate immigration.
Alito is handling some extraordinary issues involving cases from a group of states, including Texas. His order did not specify a time limit. He or the entire Supreme Court may take further action at any time.
Texas Gov. Greg Abbott signed a law last December that allows state authorities to arrest people suspected of entering the United States illegally, giving local officials powers long delegated to the federal government.
The Justice Department filed a lawsuit in January seeking to block the measure, which was originally scheduled to take effect March 5.
On Feb. 29, U.S. District Attorney David Ezra of Texas sided with the administration and agreed to preliminarily block state officials from enforcing the law, saying it “threatens the fundamental notion that the United States should regulate immigration with one voice.” “
But the New Orleans-based U.S. Fifth Circuit Court of Appeals overturned Ezra’s decision, issuing a ruling that would have allowed the law to take effect March 10, prompting the federal government to file an emergency petition to the Supreme Court. (Reuters).
