US Supreme Court gives Texas freedom to detain and expel migrants

US Supreme Court refused to block the law on Tuesday Texas supported by Republicans, allowing state law enforcement to detain migrants, suspected of illegally crossing the border between USA and Mexico, rejecting the government’s request President Joe Biden.

Moreover, the law known as SB4, It could take effect while arguments in a lawsuit brought by the Biden administration and migrant rights groups are heard.

The US presidential administration has asked judges to freeze a court order allowing the Texas law to take effect while the US government challenges the law in lower courts.

Washington claims that the law is violated Constitution and federal law interfering with the central government’s regulatory powers immigration.

SB4 was signed into law by the Governor of Texas. Greg Abbott last December, authorizing state law enforcement to detain people suspected of entering the United States illegally, giving local officials powers long delegated to the U.S. government.

Abbott said the legislation was needed, saying Biden was unable to enforce federal laws that criminalize illegal entry or re-entry.

He also said at a Dec. 18 press conference that Biden’s “deliberate inaction has left Texas in the lurch.”

Texas law makes illegal entry or re-entry into Texas a state crime and carries penalties ranging from 180 days in jail to 20 years in prison. It would require Texas trial judges to order migrants to return to Mexico, with those who refuse facing up to 20 years in prison.
