A federal appeals court has once again suspended a Texas immigration law that allows border security forces to arrest undocumented migrants entering the US from Mexico, just hours after the Supreme Court lifted the blockade.
In a brief ruling, a three-judge panel of the U.S. Court of Appeals for the Fifth Circuit voted to overturn a previous decision that temporarily enacted the law known as SB4, effectively allowing state governments to implement the measure while the legal dispute continues.
Hours earlier, the Supreme Court rejected an emergency request submitted by the Ministry of Justice, in which it asked the court to rule on the issue without explaining the reasons for lifting the blockade. Given the decision, the White House said the immigration law was “harmful and unconstitutional” and the Mexican government “categorically rejected” a measure that encourages the “criminalization” of migrants or “racial profiling.”
“Mexico recognizes the importance of a unified immigration policy and bilateral efforts with this country to ensure that the migration of people is safe, orderly and respects their human rights (…) Mexico will under no circumstances accept repatriation from the state of Texas,” he added.
The law passed by Texas Gov. Greg Abbott in December 2023, known as SB4, makes illegal entry into the state punishable by up to 180 days in jail and a fine of up to $2,000. Returns were classified as a serious crime, punishable by two to 20 years in prison, depending on the migrant’s background.
The measure is the latest attempt by Texas to challenge US President Joe Biden on immigration issues. Abbott has ordered tens of thousands of migrants to be bused to Democratic-run cities such as Chicago and New York.
State authorities have installed a chain of giant buoys in the Rio Grande to prevent migrants from crossing into the United States. Abbott has promoted other anti-immigration initiatives, such as installing kilometers of barbed wire at the busiest crossings or creating checkpoints. (Europe Press).
