Without a doubt, we are facing a particularly controversial measure that is difficult to justify, even though its main responsible person, Judge Santiago Pedraz, has declared that it is “necessary, appropriate and reasonable” and “there is no alternative“, as reported by several national media.

Obviously, as the person who gave the order to block Telegram in Spain, we understand that he adapts these assessments based on his worldview and, more specifically, based on his knowledge of the field of this type of service. And this is where, no doubt, a huge difference arises between what he considers a measure, and what the affected users think about itwhether personal, professional or both.

Be that as it may, even though the information was released 48 hours ago on Friday and as we could tell operators were given a maximum of three hours to activate the blockade, surprise and uncertainty spread. Well, at the time of publishing this news Telegram remains functional and available from Spain. Does this mean that operators have decided to ignore the court order to block Telegram? Not really.

The reason for the current situation is that according to various media The National Court has not yet sent the order telecos block access to Telegram in Spain. The complaint, which takes the issue to the European level, denounces the inadequacy of the measures proposed by Judge Pedraz and, in response, asks the European justice system to put in place preventive measures to reverse what the judge imposed.
