This opinion was expressed to Ukrainian Radio by OptiData’s cybersecurity engineer Vladyslav Radetsky, who commented on the Ministry of Defense’s initiative on the legal definition of the concept of “cyber war”.

He emphasized that the Armed Forces soldier is transparent before the law on the battlefield, fulfills his duty and protects his land. At the same time, those who carry out any offensive cyber operations against invaders are still in a legal gray area.

Commenting on the Ministry of Defense’s initiative on the legal definition of the term “cyber war”, Radetsky said: “This is a very positive signal and we really need it as a state.” – But you must understand that there is a lot of work here. It is not enough to just introduce this concept into the field of law. If there is a cyber war, then it is necessary to have a cyber army and cyber command so that this concept does not remain on paper. What can it give us in the short term? Formalizing everything at the legislative level will provide the opportunity to protect experts from our side. We have units for cyber operations in various communities as well as law enforcement – ​​“Kyberprotiv”, “Cyberalliance”. So, we need a definition of cyber warfare so that we can protect our experts who carry out certain attack operations. If we compare this with the army on the battlefield, everything is clear there: the Ukrainian defender, firing at infantry or vehicles of the invaders, is transparent before the law, performing the function of protecting his land. Currently anyone conducting any offensive cyber operation against invaders is in a legal gray area. Therefore, we need this definition to protect our cyber resilience forces. “The second point is that this will improve and strengthen the prosecution of Russian groups and hopefully affect the strengthening of sanctions in terms of software and services that can still be provided on the territory of the Russian Federation,” he said.

As reported, since the beginning of the large-scale invasion, experts of the Security Service of Ukraine have neutralized approximately 10,000 cyber attacks.
