At the hearings, Andres VillegasGlass’ lawyer, argued that the arrest of former Vice President Rafael Correa was illegal without paying attention to any regulated and arbitrary criteria, because violated their human rights depriving him of the asylum that Mexico had granted him.

For this reason, the lawyer asked the CNJ Chamber to evaluate habeas corpus to be released again and handed over to the nearest diplomatic mission after Mexico closed its embassy in Quito following a police raid to arrest Glas or the embassy of another country that would also undertake to accept him as asylum.

Villegas questioned whether the police report on the arrest operation was made public “secret” so the details are not known and indicated that “Obviously there was no search warrant.” against the Mexican Embassy and that the diplomatic mission had not previously been consulted about the possibility of carrying out this procedure through the Ministry of Foreign Affairs.

The lawyer insisted that the principle of inviolability of diplomatic missions had been violated, “and personal property such as cell phones and even an electronic tablet belonging to Jorge Glas,” who declares himself “politically persecuted”.

In his speech at the hearing in the pre-trial detention center Glas stated that he was allegedly beaten by police that they arrested him, sprained two of his fingers, took him out of the embassy in handcuffs and carried him, holding his hands behind his back, to “torture position”.

Glass also noted that the asylum granted by the government of the Mexican President Andres Manuel Lopez Obradoris an “admission” that he is a “person persecuted for political reasons”, which he asserts by declaring his innocence in the trials and convictions against him.

For her part, CNJ Penitentiary Safeguards Judge Melissa Muñoz recalled that at the time Glas entered the Mexican Embassy, ​​he did not have an arrest warrant, which was later issued because he was accused of alleged embezzlement (embezzlement). .public) in the case of reconstruction of Manabi, the province most affected by the 2016 earthquake.

He also clarified that Glas, who was vice president Raphael Belt (2007–2017), and at the beginning of the Lenin Moreno administration (2017–2021) he had to return to prison to serve an eight-year sentence resulting from two convictions for bribery and illegal association handed down in previous years.

For his part, the Minister of Internal Affairs and Government Monica Palenciajustified Glass’ arrest at a hearing Thursday, saying the Ecuadorian executive never granted asylum to the former vice president because Convention on Diplomatic Asylum argues that it cannot be granted to a person prosecuted for ordinary crimes.

He also ruled out any prosecution of Glas, “who has been prosecuted since 2017, when (Daniel) Noboa was not yet president, and not for political crimes.”

Glass’s arrest forced Mexico to sever ties with Ecuador and extradite him to court. International Court of Justice in The Hague given that both its sovereignty and international law were violated.
