Iraq passes law criminalizing homosexuality, punishable by up to 15 years in prison

He Iraqi Parliament approved this Saturday amendments to anti-prostitution law, including criminalization of homosexual relations and transgender expressionwho will now be creditors punishment up to 15 years in prison.

The Legislative Assembly reported that the amendments were approved. “Preserve moral integrity in Iraqi society from the calls for homosexuality that have swept the world” and “the lack of legislation in Iraq that would curb the punishment of homosexual acts and those who encourage them,” the statement said.

Acting Chairman of the Lower House Mohsen al-Mandalawi said approval of the amendments was mandatory. “A necessary step to protect the value structure of society and children destined for moral corruption and homosexuality”according to another statement.

Amendments to the anti-prostitution law, in force since 1988, were approved at a meeting attended by 170 of the 329 lawmakers who make up the Iraqi chamber.

Iraqi law now punishes any consensual homosexual relationship with 10 to 15 years in prison.Promoting same-sex relationships also carries a penalty of one to three years’ imprisonment and a fine of 10 million Iraqi dinars (about US$7,600).

Anyone who has undergone gender reassignment surgeryas well as the doctor who practices it will face punishment from one to three years imprisonment.

Law also provides penalties For every man who shows “feminine behavior”.

The human rights activist stated that The rule “adds insult to Iraq’s LGBT people, who already face cycles of violence and threats to their lives from armed groups.”predominantly of a religious nature.

A bill for this amendment was introduced in August 2023 by independent MP Ra’ad al Maliki. It originally stipulated that homosexual acts would be punishable by death or life imprisonment.and “propaganda of homosexuality” will mean a minimum of seven years in prison and a fine.

Although consensual same-sex sexual relations were not explicitly criminalized in Iraq, authorities used vague “morality” laws to prosecute members of the group.
