TikTok argues in its lawsuit that the law is an unprecedented step by Congress to ban a widely used app that defies fundamental constitutional principles, including the First Amendment.

The platform claims that the ban, which will come into force on January 19, 2025, will affect approximately 2025. 170 million US usersBecause TikTok serves as a unique tool of self-expression and interpersonal communication.

Efforts by TikTok lobbyists to dissuade lawmakers from passing the legislation have failed; lawmakers prioritized national security due to concerns about potential data access by China. Given TikTok’s large user base, which includes nearly half the population in the United States, the perceived risks are significant.

The judiciary is now tasked with examining TikTok’s claims and determining whether the law actually violates constitutional freedoms, including freedom of expression, and other established norms in the United States.
