The media itself announced that the case is in the appeals court after the first decision concluded that the case should not be heard in US courts.
Now Google, Github, Linkedin, Trend Micro and Big Clouds have filed a “friend of the court” appeal in join the lawsuit filed by journalists Carlos Dada, Daniel Lizarraga (Mexico) and other plaintiffs.
The companies say the United States has a “strong” interest in pursuing legal action against the spyware program.
They argue that national security and public interest issues are at stake and that local technology must be protected from foreign hackers.
The companies argue that the first ruling did not address the use of the spyware against journalists and officials, including those at the State Department.
“The district court never mentioned the Commerce Department’s decision. “Nor did it acknowledge that NSO’s repeated sales of powerful spyware to foreign governments had already led its clients to spy on journalists, dissidents, heads of state and even nine State Department employees.”
The companies say the United States is part of an “international technology ecosystem” that is affected when governments or companies develop programs that violate human rights.
