Texas’ lawsuit against Biden administration ends buoys installed in Rio Grandeon the southern border of the United States, promises to continue even though the passage of migrants across the border has fallen to the levels of the previous administration.

Texas Gov. Greg Abbott, a Republican, celebrated the decision Fifth Circuit Court of Appeals which ruled on Tuesday evening that the floating barrier his government erected in the Rio Grande last July can remain standing.

We fought to keep these barriers in the water, and the Fifth Circuit has decided that they will remain there. The fight is far from over.

The court’s decision reverses a previous decision by a three-judge panel of the aforementioned court and a ruling by Judge David Ezra issued September 6th last year, the state to remove the installed portion of the buoys.

It would be Texas’ first legal victory over the floating barrier after a lawsuit filed by the U.S. Justice Department sought to remove the buoys on the grounds that they constitute “obstruction of navigation” of the Rio Grande (Rio Bravo in Mexico).

For its part, the Texas government defended the installation of the floating barrier, arguing that it was forced to take action on its own to “defend” itself against an “invasion” of migrants, given that the White House had taken no steps to secure the southern border.

On appeal, Texas argued that Judge Ezra erred in his finding that the buoys were an obstruction to navigation on the river and that he abused his discretion in ordering the buoys to be removed.

“Texas will continue to defend our constitutional right to secure our southern border to keep our state and nation safe,” Abbott reiterated in a statement.

But the argument about a large influx of illegal immigrants crossing the country’s southwest border appears to have run its course following the Biden administration’s asylum-strapping restrictions last June.

According to data released Thursday by CBS, arrests in July fell to September 2020 levels, with 56,000 aliens arrested that month for illegally entering the southwest border.

Because of the buoys, the Mexican government has repeatedly asked the United States to remove the barrier, arguing that most of the buoys are located on Mexican territory.

The International Boundary and Water Commission, a binational organization, confirmed that claim in a report submitted to the Ezra court, which concluded that the vast majority of buoys are on the Mexican side.
