Austrian privacy NGO Noyb presented on Monday complaints in nine European countries, accusing X (formerly Twitter) of violating European Union (EU) laws for use millions of users’ data without consent to train your artificial intelligence (AI).

The complaint, according to Noib, was filed with data protection authorities. Austria, Belgium, France, Greece, Ireland, Italy, Netherlands, Poland and Spain. for violation of the EU General Data Protection Regulation (GDPR).

The NGO accuses X, a company controlled by tycoon Elon Musk, of Fill your AI technology with personal data around 60 million European users without informing them or seeking their consent, as required by European law.

“Recently Twitter (now “X”) began to illegally use personal data of more than 60 million users train its AI technology without the consent of its users. Unlike Meta (which also recently had to stop training AI in the EU), Twitter did not even inform its users in advance,” the NGO notes.

Since X has started using this personal data and there is no way to delete the data already processed, Noib demands ’emergency procedure’ so that the authorities can quickly take action on this matter, demanding a preliminary suspension of this practice.

Noib says he knows that last week the Irish Data Protection Commission (DPC) filed a lawsuit against X, but believes that this demand is based on “superficial” aspects, and not on the essence of the problem: the massive and illegal acquisition of private data of European citizens.

“The data center seems to be acting superficially, not at the core of the problem,” ” says lawyer Max Schrems, founder of Noyb, who is known for one of his previous lawsuits overturning a previous agreement on automatic data transfer between the EU and the US.

According to the NGO, most users have learned about the new AI configuration. via a viral post on X On July 26, 2024, instead of receiving direct information from the company and giving it the opportunity to opt out.

Noib, whose acronym comes from the English expression “None of your business,” demands a “full investigation” of the actions and that there are numerous unknown questions to be answered, such as how the company separates the data of its European customers – which is required by community standards – from the data of other users.

Privacy activists say the complaint to data protection authorities in nine countries, which are supposed to act to protect the rights of their affected citizens, was filed to increase pressure on X so that it complies with the fundamental aspects of European legality.

Finally, Noib points out that there was a simple solution that X ignored, which consists of request user consent to process your data.

“If even a small number of its 60 million users had given their consent to train its AI systems, Twitter there will be more than enough training data for any new AI model. But asking people for permission doesn’t seem to be Twitter’s current approach,” Noib laments.
