A Brazilian Supreme Court judge ruled on Friday “immediate” closure of the social network in the country, following the billionaire Elon Musk Violates Appointment Orderwithin 24 hours the legal representative of the platform in Brazil.

Judge Alexandre de Moraes, the author of the ruling, ordered the National Telecommunications Agency (Anatel, the regulator) to “immediately take all necessary measures” to ensure that the decision takes effect “throughout the entire national territory.”

The sentence is part of an investigation into the spread of false news that implicated a South African businessman in offences of obstruction of justice, criminal organisation and incitement to commit crime.

De Moraes said he made the decision due to “failure to comply with court orders”

In this sense, he ordered an “immediate” suspension of operations until all court orders “are complied with” and the million dollar fines imposed on X are paid.

The judge claims X is being used to spread Nazi, fascist, anti-democratic and hate messages.

The judge also said the platform was being “instrumentalized” by “extremist groups” through the “mass dissemination of Nazi, fascist, anti-democratic and hate speech” ahead of municipal elections in October.

This whole mess started a few months ago, after a judge ordered a number of profiles to be removed for allegedly sharing misinformation, and Musk refused to do so, accusing the judge of acting without apparent cause and covertly.

Some of these profiles belong to bloggers and members of the far-right led by former President Jair Bolsonaro (2019–22), who are also being investigated for spreading fake news, attacking democratic institutions, and conspiring to commit a coup d’état.

In response, De Moraes seized the bank accounts of Musk’s Starlink, a satellite internet service company with 215,000 active lines in Brazil, as a way to ensure payment of the fines levied against X.

On Wednesday, he forced Musk to appoint a legal representative in Brazil within 24 hours or face X’s removal, which happened on Friday.

Musk reacts aggressively to Brazilian judge

Musk has consistently responded with harsh criticism of De Moraes, as well as Brazilian President Luiz Inacio Lula da Silva.

“This guy is a criminal of the worst kind who pretends to be a judge (…) He is the dictator of Brazil and Lula is his lapdog,” the Tesla and Space X owner responded recently in a series of messages, in which he also compared the judge to villains from the Harry Potter and Star Wars sagas.

Brazil is one of the countries in the world with the most active X users, with around 20 million.

This is not the first time that the Brazilian justice system has decided to suspend the activities of a social network. This has already happened to YouTube (2007), WhatsApp (2015 and 2016) and Telegram (2023) due to lack of cooperation in various judicial investigations. (EFE)
