Nvidia in the sights of a patent lawsuit over DPUs

Nvidia and Microsoft are the target of a lawsuit filed by the unknown Xockets, alleging that the parties intentionally infringed patents.

The start-up Xockets accuses Nvidia of deliberately ignoring patents together with Microsoft and the IP risk specialist RPX. According to Xockets, the three parties worked together to bring technologies covered by the patents to market.

Xockets has patents that describe the architecture in a fairly high-viability way to smoothly shift workloads from CPUs to accelerators such as DPUs. The company is said to have presented the ideas to Microsoft back in 2016. In addition to Microsoft, Mellanox, which is now part of Nvidia, is also said to have secretly started working on the blueprints.

Important for large clusters

The company claims that the proprietary technology is essential for building large GPU clusters, such as those used today for AI training. The Nvidia ConnectX SmartNICS as well as the BlueField DPUs and the NVLink Switch are said to result from the patent infringements.

Xockets wants a judge to settle the dispute and is demanding that the sale of Nvidia Blackwell GPUs be prevented. Nvidia has not yet responded to the matter. Patent cases are complex, especially in the US, because it is possible to patent subject matter that is sometimes not very specific. The question is what mat Xockets really has a valid patent on. Nvidia will claim that it has based its work on an architecture and ideas that have been around for some time. The company has not yet officially responded.
