The European Commission does not appoint X as gatekeeper. This means that the social media company escapes the strictest requirements of the DMA legislation.
X is then not considered a gatekeeper under the DMA. Since May, the European Commission has been conducting a study on the impact of the former Twitter as a social media platform. For X, this decision means that it will escape stricter regulations.
“The Commission has concluded that a press release.
Good news for Elon Musk, who doesn’t have much interest in European legislation. X was in danger of falling under gatekeeper status because it has 45 million active users in the European Union. After the investigation, the Commission concluded that X’s impact on the internal market “is not significant enough” to qualify the company as a gatekeeper.
In this study, X appears to have been saved by its miserable advertising revenue. Since Elon Musk took over the company, many companies have closed their advertising portfolio on X in protest against Musk’s handling of the platform. Musk also convinced the commission by arguing that he only offers first-party advertising and therefore does not collect user data like Google and Meta do.
X is on the run for now, but the company remains on the European Union’s radar. If advertisers ever return to the platform, it could still impact the outcome of the study. The Company is also subject to enhanced supervision under the DSA legislation and related obligations.
A select group of tech giants have been designated as gatekeepers by the European Union under the DMA legislation. These include Apple, Meta, Microsoft, Alphabet (Google), Amazon and ByteDance (TikTok).
