The European Commission is once again targeting Apple. This time it’s about a possible violation of the anti-geoblocking rules regarding Apple Media Services.

Apple scores poorly again with the European Commission. In a press release, the EU said it had “informed Apple” that it may be violating EU anti-geo-blocking rules. According to a consumer protection investigation (CPC), Apple would discriminate against European users based on their place of residence. This discrimination affects Apple media services such as the App Store, Apple Music, Apple TV+ and more. Apple now has a month to commit to cracking down on geo-blocking practices.

Discrimination at place of residence

Consumer Protection (CPC) conducted a “coordinated investigation” against Apple. This investigation revealed a number of restrictions on Apple Media Services that unlawfully discriminate against European consumers based on their place of residence. More specifically, it would include restrictions related to online access to Apple Media Services, inconsistencies in payment methods and app availability.

The Apple Media Interfaces differ between the EU and EEA countries. This means that in the app version, consumers can only access the interface from the country in which they registered their Apple account. Because users cannot access other countries’ interfaces, they cannot download apps offered in other countries. Additionally, consumers can only use payment methods issued in the country where they registered their Apple account.

Bad points

Apple now has a month to respond to the results of the investigation. The company must “propose commitments to combat geo-blocking practices.” The CPC network can then initiate a dialogue. If Apple fails to meet these obligations, the European Commission may take enforcement action against the company.

It is not the first time that Apple has come into contact with the European Commission. There is currently a possible first DMA penalty for Apple that relates to the App Store. Apple would undermine alternative iOS app stores and thus the steering– Failure to comply with the provisions of the Digital Markets Act.
