A 100-year-old former Nazi concentration camp guard He could be tried in Germany for complicity in 3,322 murder cases after the Frankfurt Regional Court decided to overturn a court decision not to prosecute him.

The court said in a statement on Tuesday that the case will be sent back to the Hanau court, which will have to once again decide on the defendant’s fitness to stand trial despite his advanced age.

The former security guard, identified in the German press as Gregor Formanek, was accused in the summer of 2023 of complicity in 3,322 murders were committed by the Nazis in the concentration camp from Sachsenhausen, in the east of the country.

In February this year, an expert determined that the elderly man was not fit to stand before a judge, so the Hanau court decided not to initiate criminal proceedings against him.

However, the Frankfurt Regional Court said in a ruling this week that the expert opinion had significant flaws and that Hanau Court must ensure that the assessment meets minimum standards.

Born in 1924, Formanek joined the Nazi SS in 1943 and was sent to Sachsenhausen, where it is estimated that a total of about 200,000 prisoners passed through, between July of that year and February 1945, according to media reports.

According to the prosecution, the former guard at the time was responsible for monitoring the prisoners, as well as transportation of prisoners from the train station and must have been aware of the conditions that prevailed in the camp, where it is estimated that tens of thousands of prisoners were executed and died from abuse and disease.

If Formanek sits on the bench, this will be one of the last processes for the team. Nazi crimesdue to the advanced age of the criminals who still survive.

In 2022, another former Sachsenhausen camp guard, then 101 years old, was sentenced to five years in prison for complicity in 3,500 murders.

That same year, the former secretary of the Stutthof concentration camp was sentenced to two years in prison for complicity in 10,505 murders.
