A court in Bogota has banned the sale of iPhones and iPads with 5G in Colombia because, according to its ruling, Apple infringed the patent for developing this technology, which was awarded to Ericsson in 2019.

This is a decision by the 43rd court of the Bogota circuit that affects all Apple models using this technology, as Apple and Ericsson made a bargain so that the American tech company could renew a license agreement signed between the two in 2015, but failed.

Due to the failure of this negotiation for the use of 5G in their terminals, both companies sued each other. According to local media reports, the court found that Apple finally infringed the patent granted to the Swedish company to develop 5G technology, valid until December 2037.

Apple banned from selling and marketing products

Therefore, according to the court order, Apple cannot import, sell, market or advertise products that violate that patent. He also ordered the Tax and Customs Department (DIAN) not to import these devices, which cover the entire iPhone range from 12 and several iPad pros.

Apple does not have retail stores in Colombia, but imports and sells its products through third-party stores and operators.
