O Ministry of Justice suspended the sale iPhones without a charger in Brazil, in addition to imposing a fine of 12 million reais on Apple if the company does not comply with the court order. The order was published on Tuesday in issue (6) of the Federal Official Gazette.

The decision taken by the Ministry of Justice comes into force immediately after publication in the Official Gazette and applies to all models starting with the iPhone 12 released in 2020. It was the first model in which Apple began selling chargers separately, leaving them in the box when purchasing the device.

At the time, the company said it stopped adding the charger to the box to reduce waste and reduce the impact it could have on the environment. The stance has been copied by Samsung, which has also begun to apply the same strategy as Apple to cell phones that are considered premium.

“Application of a fine of 12,274,500 (twelve million two hundred and seventy-four thousand five hundred reais) reais, deregistration of the iPhone brand smartphones on the market from the iPhone 12 model and immediate suspension of the supply of all iPhone brand smartphones, regardless of model and generation, without a charger “, the order says.

Procon accuses Apple of collusion

At the end of last month, Procon in Rio de Janeiro fined Apple 12 million reais for selling iPhone 12 cell phones without chargers. The Consumer Protection Agency claims that the company’s stance is set up as a sidebar, given that the charger is required for the device to work and forces the individual to purchase one separately.

In addition to the fine, Procon-RJ also filed two more notifications with Apple due to the lack of chargers in the iPhone 13 and 14 models for $36 million.

However, the 12 million reais fine imposed by the procon of Rio de Janeiro is not the first that Apple has received due to the lack of chargers in iPhones. This is because São Paulo Procon also imposed a fine on the company for the same reasons.

Also in Brazil, regulators in Florianopolis and Fortaleza also imposed fines on Apple. In April, it was the turn of a consumer in Goiania to file a lawsuit against the company and earn BRL 5,000 for having to buy a charger separately from the device.

Taking no position on the matter, Apple doesn’t seem to be very interested in changing the way products are made. This is because it is estimated that it has already saved more than 6 billion US dollars, about 30 billion reais at the current price, with the practice carried out since 2020.
