A London court dismissed Apple’s appeal in its patent dispute with Optis Cellular. This was reported by the Reuters agency. Now the American IT giant has to pay its rival for license cuts resulting from iPhone sales. Otherwise, Apple could be banned from selling smartphones in the UK.

Transactions between Apple and Optis Cellular began in February 2019. The second company accused Apple of infringing its patent rights for the use of technologies that provide 3G and 4G communication to smartphones. Subsequently, the dispute between the companies resulted in six protracted lawsuits in Great Britain alone. A few more people are going to the USA.

In its appeal, Apple noted that Optis Cellular occupies a dominant position in the market as it holds patents for key cellular communication technologies. However, on October 27, Judge Richard Arnold denied the IT giant’s claims and upheld the lower court’s decision.

Therefore, Optis Cellular may limit Apple’s right to use patent-protected technologies when the IT giant fails to comply with “fair and reasonable” license terms for third-party solutions. Simply put, Optis Cellular could ban Apple from selling iPhones in the UK if it doesn’t charge license fees on smartphone sales. However, this will not happen until the court determines what is “fair and reasonable”.

Prior to that, one of the lawsuits between Apple and Optis Cellular ended when the IT giant was ordered to pay $300 million to the rights holder.
