“The Department of Homeland Security (DHS) and the Department of Justice (DOJ) are issuing a proposed rule encouraging the use of new and existing legal procedures and discouraging unsafe border crossings by introducing new condition on the right to asylum for those who do not”, read the statement.

According to the proposal, migrants who do not use available routes to travel to the United States or who are not seeking humanitarian asylum in another country they passed on their way to the United States will not be considered eligible for asylum unless they qualify for certain exceptions, after which they will be subject to a five-year re-entry ban.

“We are a nation of immigrants and we are a nation of laws. We increase the availability of legal and orderly routes for migrants to the United States, while offering new consequences for those who do not use processes provided by the United States and its regional partners,” Secretary of State for Homeland Security Alejandro Mallorcas said.

In this sense, he emphasized that “it is less likely that people who are provided with a safe, orderly and legal route to the United States, risking their lives traveling thousands of miles at the hands of ruthless human traffickers.”

The new offer will not take effect immediately. It will go through a regulatory process so that it can be discussed within 30 days. After this time, the policy will be in effect for the next two years.

The new restrictions follow the announcement at the end of January of the end of the Covid-19 emergency and therefore Section 42, which allows the expulsion of migrants on health grounds.

Under this expanded program Migrants from these four countries will be issued 30,000 monthly humanitarian permits, but those who cross the border irregularly will be deported to Mexico.
