Procon-MG fined Shopee BRL 7 million for non-delivery of goods…

In its defense, the company stated that the data provided by the applicant was not true.

After receiving a complaint from a consumer, Procon decided to fine Apple Brazil 12 million reais for selling an iPhone without the included charger. The Ministry of State of Minas Gerais (MPMG) reported that a customer stated that the new technology used by Apple requires specific and compatible charger models, forcing the consumer to spend more money. Apple, in turn, told g1 that it would appeal the decision.

According to prosecutor Fernando Martins, the Regional Coordinating Council initiated an administrative process through a ruling based on the damage caused to the region. This position differs from the hypothesis already considered by the National Consumer Secretariat (Senacon).

The PA, created by Procon-MG, also highlights the importance of new charger models and abuse of the weakness of consumers who lack the same technological mysteries as the global brand, their legitimate expectations have been violated.“, said the prosecutor.

tie-in sale

The responsible authority under administrative procedure (PA) investigated the case and found that there was a practice of “tied selling”, as a result of which prosecutor Fernando Martins pointed out the following violations of the Consumer Protection Code:

  • condition the sale of a product or service on the provision of another product or service without good cause or limit the quantity;
  • Take advantage of the fragility or ignorance of the consumer due to his age, health, knowledge or social status in order to promote goods or services;
  • Sell unsuitable or unfit for consumption goods that may reduce their value;
  • Non-compliance with an offer, promotional or not, containing reliable information about a product or service.

After a conciliatory hearing with representatives of the company, the prosecutor stated that the company was not interested in resolving the conflict. In view of this, the State Ministry of State of Minas Gerais (MPMG) has decided that Apple Brasil must pay a fine of R$ 11,999,504.59 to the State Consumer Protection and Protection Fund of Minas Gerais. After notification, the company will have ten business days to file an appeal.
