As noted, the decision was taken in a lawsuit filed by the Consumers’ Association and the Data Privacy Foundation (DPS).
“The court ruled that Facebook did not sufficiently inform Dutch users about what the platform was doing with their data. With this, Facebook violates privacy law, which ensures that it is always clear for what reason and for what purpose certain confidential data is being processed.”
Specifically, as noted, Facebook uses data from Dutch users to serve ads without legal permission. It also provides access to information such as the user’s gender, age, place of residence, the applications he uses, and information about his Facebook friends.
The court decision covers the period 2010-2020.
Last year, a consumer association urged Dutch Facebook users to join it in a lawsuit against the social network. Now there are about 190,000 of them.
The organization had previously stated that this court decision “opened the way for compensation claims.” In particular, the Consumers’ Association may go to court again or start negotiations with Facebook for reconciliation, but no decision has been made yet.
Facebook’s parent company, Meta, will appeal the Dutch court’s decision.
