Apple has been fined 5 million reais for misleading ads related to the water resistance of the iPhone 11.. The company was found guilty of violating collective, diffuse, individual and indivisible trans-individual rights, and the amount payable will be directed to the National Fund for the Protection of Diffuse Rights.
The indictment was handed down by Judge Roberto Cesar Oliveira Monteiro, who serves on the 7th Civil and Commercial Court of Belém do Para, following a lawsuit filed by the Brazilian Association for Education, Culture, Defense and Protection of Consumers, Taxpayers and the Environment. (ADECAMBRASIL).
Each buyer of the iPhone 11, 11 Pro and 11 Pro Max models will be eligible to receive 1500 reais from Apple. as compensation for misleading advertisements regarding the waterproofness of appliances. To receive value, the consumer must prove that he was harmed and which is part of a class action lawsuit filed against the company.

The class action lawsuit against Apple was based on misleading ads for the water resistance of the iPhone 11 models. Many consumers have claimed that their devices have been damaged after minimal contact with liquids.. Notwithstanding the company’s disclosures, the warranty does not cover such damages that cause loss to customers.
The group that filed a class-action lawsuit against Apple demanded compensation of more than 100 million reais due to misleading advertising about the water resistance of the iPhone 11. They received 5 thousand reais. The amount, as noted earlier, was not accepted by the court.
Apple can still appeal the decision
Apple stated that ADECAM would have an opportunistic stance and that it would not have legal authority to represent all affected consumers because it did not attach a list of accomplices to the case. The company also denied allegations of partial or incomplete advertising, stating that water resistance does not mean that a device is water resistant.
The Cupertino-based company is yet to appeal the decision and claims the charges against the company are unfounded. The company claims to follow NBR IEC 60529:2017 water and dust resistance certification standards. However, this does not mean that the device is waterproof.
