Uber treated the case as if it were a forgotten object, but the customer claimed it was a theft.

Justice realized that the footage from the race clearly showed that the driver had received the cake and fled with it, staging the crime of stealing. The judge also emphasized that Uber is jointly responsible for what happened, as it provides services, manages the business and registers drivers working under its flag.

“The platform is jointly and severally liable in cases where, given that its activities provide services, manage business and make a profit, it also registers drivers operating under its flag.“said Judge Diva Maria de Barros Mendez.

In addition to the return of the money paid for the cake, the customer will receive compensation for non-pecuniary damage in the amount of 5,000 reais. The judge pointed out that there had been a breach of trust, frustration and psychological shock due to the theft of goods on a special date. The company can still appeal this decision.
