This 1931 law lay dormant for decades after the U.S. Supreme Court allowed the right to abortion at the federal level in 1973 with its ruling “Rowe vs. Wade“.
However, after this highest court of the country annulled its decision No. 73 on June 24, 2022, disputes about the validity of this state decision flared up again.
Last September, the Michigan Court of Appeals declared the 1931 abortion ban unconstitutional and issued permanent injunction which prohibited the exercise of this veto by the Attorney General and District Attorneys.
In a decision effective immediately, the state court affirmed that the 1931 veto was “completely unconstitutional, since its application would deprive pregnant women of their right to bodily integrity and autonomy and equal protection before the law.”
But the ordinance in question has not yet been removed from state law, which was made possible by the State Congress on March 10, and which is now comes into force signed by the governor.
In Michigan, in the Midwestern United States, its citizens voted in last November’s midterm elections to include the right to abortion in the state constitution in a way that would insulate it from future attempts by conservatives to repeal it.
