The US Department of Justice presented this Monday appeal against a Texas federal judge’s ruling to stop nationwide marketing of mifepristone as an abortion pill.

President Joe Biden’s administration has reached out to Court of Appeals for the Fifth Circuit in New Orleans (Louisiana)to stop a judge’s “extraordinary and unprecedented” ruling against medical abortion.

On appeal, he argued that mifepristone It is a “safe and effective treatment” for abortion that has been approved by the scientific community for decades.

The appeal was upheld by 24 state attorneys general, led by New York, who filed a government legal document in court and requested that the order not be enforced while the appeal is pending.

The case started last Friday when Texas Federal Judge Matthew Kachsmaric ordered the Food and Drug Administration (FDA) to revoke the authorization for the use of mifepristone, which had been in effect since 2000.

In the ruling, the judge argues that the FDA violated due process in approving mifepristone without considering the drug’s “adverse health effects”.

Kaczmarik, nominated by former Republican President Donald Trump (2017-2021), gave the order a week to go into effect so that Democrat Joe Biden’s government could appeal it.

Vice President of the United States Kamala Harriswho has championed the cause of reproductive rights in government, said on Friday that the court’s decision sets a “dangerous precedent.”

For his part, he Health Minister Xavier Becerrapromised on Sunday that the government would do “everything possible” to keep the pills available in the country and did not rule out the possibility that the FDA would ignore the court order.

The United States has been in a political and legal battle over abortion since the Supreme Court overturned the constitutional right to abortion by a conservative majority last June, after which dozens of Republican-run states curtailed the practice.

According to the Guttmacher Institute, 54% abortions in the United States in 2022, they were with abortion pills such as mifepristone or misoprostol.
