Supreme Court of the United States blocked new restrictions To Mifepristone abortion pill imposed by lower courts last week.
The decision means keeping the status quo on drug access unchanged, at least until an appeals court decides the legality of the US regulatory approval for the drug more than 20 years ago.
The Court of Appeal in question is the Court of the Fifth Circuit, which includes the states Texas, Louisiana and Mississippi— Approved restricting access to mifepristone when considering a decision by a Texas judge to completely ban access to the pill, which is used in more than half of the nation’s abortions.
This ruling means for the first time, a court ruled in an abortion-related case after his controversial decision last summer to revoke the constitutional protection he has enjoyed since the 1970s, sparking a wave of restrictions in conservative-ruled states.
In a message on the court’s decision, US President Joe Biden stressed that “… mifepristone remains available and approved for safe use and effective as long as we continue to fight in the courts.”
The President assured that his government would continue to defend regulatory approval of mifepristone and stated that he will continue to “combat politically motivated attacks on women’s health.”
This Friday, the country’s highest judicial body decided to temporarily block a number of restrictions that the Fifth Circuit Court of Appeals issued last week, such as a ban on prescribing pills after seven weeks of pregnancy or mailing them.
two of the most conservative judges on the court, Clarence Thomas and Samuel AlitoThey disagreed with the decision.
By order, the case is returned to the Court of Appeal, which has set a date for the start of the trial. oral arguments for the next 17 May.
At the center of the litigation is the Food and Drug Administration (FDA) approval for the use of mifepristone 23 years ago.
He Texas Federal Judge Matthew Kachsmaricappointed by former President Donald Trump (2017-2021), ordered on April 8 to revoke the authorization to use the abortion pill.
The order was appealed by the Joe Biden government, and a Louisiana appeals court ruled that the drug would only be available until the first seven weeks of pregnancy, three fewer than before, and that it must be picked up in person, among other restrictions.
But the Justice Department took the case to the Supreme Court, arguing that the restriction serious consequences for women and for the pharmaceutical industry, where the high court had to intervene.
Organization Planned Parenthoodwhich operates the largest network of reproductive health clinics in the country, celebrated the decision this Fridaybut warned that women’s health should not be at the mercy of the judiciary.
“We are pleased that access to mifepristone will continue to be protected while this pointless business continues. We can take a breather, but without losing our vigilance,” organization president Alexis McGill Johnson said in a statement. (EFE)
