Last Monday (24), the U.S. Ninth Circuit Court of Appeals upheld the decision of a trial judge convicted in 2021, which dismissed claims that Apple violated a federal law banning third-party app markets on your operating system. “There is a lively and important debate about the role played in our economy and democracy by online transaction platforms with market power.“, – said a panel of three judges. “However, our job as a federal court of appeals is not to decide this dispute, and we cannot attempt to do so. Instead, in this decision, we apply existing precedent to the facts in good faith.“.
Apple welcomed the decision and remains firm in its position that it does not have a monopoly on its platform. She claims that one of the reasons why external app markets are banned from the App Store is to prioritize the safety of its users. “The App Store continues to drive competition, drive innovation, and empower, and we’re proud of its tremendous contribution to the lives of users and developers around the world.“, the company said in an email. “We respectfully disagree with the court’s decision on the sole remaining claim under state law and are considering further review.”

In 2021, U.S. District Judge Yvonne Gonzalez Rogers found that Apple did not allow its consumers to receive tiered pricing, although she rejected Epic’s claims that the App Store was operating as a monopoly in violation of federal antitrust laws.
The tests were then applied in California, and after them, Judge Rogers ordered Apple to allow app developers to direct their consumers to external payment methods. However, she did not see a need for third-party app stores on the platform, or for Apple to rethink its app developer fee policy.
Although it lost to Apple in most of the claims, it doesn’t look like Epic Games is discouraged and it seems that there will still be new chapters in this soap opera.
