The US Army sergeant was sentenced on Wednesday to 25 years in prison for killing an armed demonstrator during a protest against racism in Texas.

Daniel PerryA 36-year-old white man was convicted of murder in April for killing 28-year-old white man Garrett Foster at a rally in support of the movement.Black Lives Matterin July 2020 in Austin, after the death of African-American George Floyd at the hands of the police.

Perry Clinton Broden’s lawyer said in a statement after learning of the verdict that his client would appeal the decision, which he called “political persecution,” according to national media.

Republican Texas Gov. Greg Abbott indicated his willingness to pardon Perry before sentencing, saying he would sign the pardon when recommended by the state Board of Pardons and Parole, composed of Abbott’s own appointees.

Similarly, Clifford Brown’s Circuit Assize Court noted that the defendant had “fair and impartial tribunall” and that this resolution “deserves respect”. It is not yet known when the council will make a decision.

On Tuesday, the defense demanded that the Air Force veteran be sentenced to 10 years in prison, citing his lack of a criminal record and post-traumatic stress disorder. On the other hand, the prosecution requested 25 years, pointing to his racist social media posts prior to the incident.

Perry said he played self defensewhen he was trying to drive his car through the crowd when he shot at Foster after seeing him aiming at him. However, witnesses stated that they did not see Foster raise his weapon.
