The US Department of Homeland Security and Justice has unveiled new immigration rules that will replace Section 42 when it expires this Thursday at 11:59 pm.

“rule complements effortswhich combines legal avenues with consequences for those who do not use those avenues, and places certain restrictive conditions on the right to asylum for those who do not resort to such avenues,” the joint statement said.

The rule assumes that those who do not use legal routes to enter the United States are not eligible for asylum, and allows the United States to remove people who do not demonstrate a reasonable fear of persecution or torture in the country to which they are being removed.

Foreign nationals can only rebut this presumption on the basis of exceptionally compelling circumstances.

“This ruling will encourage migrants to seek access to such routes instead of arriving illegally and at the mercy of smugglers on the southern border,” Homeland Security Secretary Alejandro N. Majorcas said.

“We continue to urge Congress to act on President Biden’s proposed immigration reform, bipartisan legislation to protect Dreamers and agricultural workers, as well as repeated calls for more resources to hire more asylum officers and immigration judges so that we can fix our long-distorted immigration system once and for all,” Majorcas added.
