Actually it isn’t. Let’s start with the fact that the Code of Administrative Offenses contains only three articles, one way or another related to the operation of a car without an emergency module. And they all relate to vehicles engaged in freight and passenger transport. As for passenger cars, the Code of Administrative Offenses is silent like a fish out of ice! For ease of understanding, we list the sections of the Code that pertain to the absence or inoperability of the ERA-GLONASS module.
Firstly, this is art. 12.21.2 “Violation of the rules for the carriage of dangerous goods.” According to it, the driver will be fined 1000-1500 rubles, and the owner of the car 150,000-200,000 rubles
Secondly, Article 14.1.2 of the Code of Administrative Offenses of the Russian Federation “Conducting entrepreneurial activities in the field of transport without a license.” Because without the GLONASS module on the vehicle it is impossible to obtain a passenger transport permit. According to this article, an official or individual entrepreneur is entitled to a fine of 75,000 rubles, and a legal entity – up to 400,000 rubles.
And thirdly, there is also art. 12.31.1 of the Code of Administrative Offenses of the Russian Federation “Violation of the requirements for ensuring the safety of the transport of passengers and luggage, cargo by road and electric ground transport.” Here the driver is entitled to a fine of 1,500 rubles, and the legal person-owner of the vehicle – 25,000.
