Delegates propose to abolish fines for transporting children without a seat

Chairman of the State Duma Committee on Labor, Social Policy and Veterans Affairs Yaroslav Nilov submitted a proposal to the Government of the Russian Federation to abolish fines for transporting children without special restrictions. But, of course, we are not talking about all small passengers – only those who cannot sit on a seat due to developmental features.

Some diseases prevent the use of coercive measures during transport. For example, with cerebral palsy, a small passenger can only be transported in a lying position and with autism not be fastened with seat belts. However, the traffic rules do not take into account such features, and parents of motorists are forced to pay rather high fines after each meeting with traffic police officers (3,000 rubles, Article 12.23 of the Code of Administrative Offenses of the Russian Federation).

The deputies who drafted the amendments propose to exempt drivers transporting disabled children under 11 from administrative responsibility if their physiological characteristics do not allow them to comply with the requirements of the traffic regulations. The document is already under consideration by the government of the Russian Federation. And as soon as the authors receive an official response, the project will be submitted to the State Duma.

– I have submitted an application to the Ministry of Internal Affairs of Russia with a proposal to change the traffic rules so as not to put drivers of cars carrying disabled children under administrative responsibility. It’s not their fault that some diseases don’t allow putting children in regular car seats and securing them with seat belts, as required by traffic regulations. And special car seats are a priceless luxury for many,” wrote Yaroslav Nilov in his Telegram channel.

The traffic police is against changes to the traffic rules. As evidenced by the letter to Nilov (our colleagues from Izvestia got acquainted with a copy of it), the department recommends drivers with disabled children to avoid fines to use the services of a social taxi. Clearly, law enforcement officers are unaware that caring for a child with a disability is a permanent means of transportation. Otherwise, they would not give such “good” advice to the citizens of a country where the average income barely exceeds 35,000 rubles per month.

In turn, representatives of the medical community offer another solution to the problem. Since in some diseases it is really impossible to use conventional devices, and transporting children without these devices is extremely dangerous for life and health, doctors urge to clarify the formulation. They believe that if special devices were also included in the concept of a child seat, parents would not have to worry about the child’s condition or fines.
