LDPR deputy Yaroslav Nilov made a proposal to emphasize in the Code of Administrative Offenses accidentally leaving the scene of an accident and punish it with a fine of 1,000 rubles – as for the driver’s failure to fulfill his duties in related to an accident in accordance with Article 12.27.1. Now, regardless of whether the motorist is intentional, they are deprived of their “rights” for up to a year and a half or even imprisoned for 15 days.
As Yaroslav Nilov reported in his Telegram channel, this decision could change legal practice for the better. He expressed the idea of dividing responsibility between drivers who hit someone else’s car and deliberately drove away, and those who simply did not notice what happened, in the State Duma during a meeting of the expert council on the protection of the social orientation in transport. .
The initiative sounds reasonable, because sometimes the driver does not really notice how he scratched a parked car, and as a result he is deprived of his “rights” under Article 12.27.2 of the Code of Administrative Offenses of the Russian Federation. Even if he is willing to fully compensate the damage!
Nilov noted that such accidents are now “managed” by scammers – they set up “setups” on the roads and convince the driver that it was he who damaged their car and that he will now be deprived of his “rights” if they call the traffic police. And to prevent this, they of course occasionally demand a nice amount of money from the victim.
It only remains to add that the deputies have sent the proposal to the Ministry of the Interior for consideration.
