In the provinces, various types of police ‘ambushes’ are often used, intended to supplement the local treasury with fines. For example, on a country road where the speed limit is 90 km/h, a speed sign “60 km/h” or even “40 km/h” suddenly appears. Sometimes they are hanged, as they say, “not from evil”, but after several accidents that happened in this place: to report that, in their own words, preventive measures have been taken, everything is under control. And only then, in the “set” to the sign, there is also a camera … Because of this, the driver calmly drives along a good flat road in the “penalty-free” high-speed corridor of about 100 km / h, suddenly sees an unexpected sign ” 40″ (without warnings) and then receives a fine.

The existence of such a trap is possible due to the violation of the rules for installing speed limit signs. GOST requires that in such cases a “stepped” lowering of the step of not more than 20 km / h is applied. That is, if the movement of 90 km / h was allowed, you must first set a restriction sign to 70 km / h, then another – up to 50 km / h, and only after that – a “kruglyash” with the number 40.
In addition, such signs on the highway (according to GOST) should be placed no closer than 100 meters from each other. But in the field, such “little things” often spit and do not spend a budget on the installation of “extra” boards. This is a violation of GOST R 52289-2019, which is stated in the traffic rules.
“On this basis, such a fine ‘for speed’ can be completely withdrawn, including through the courts,” says car lawyer Mikhail Nikitin.
To begin with, you must send a request (by post or, if possible, in electronic form) to the municipality about the presence of signs on the integrated traffic management scheme (KSODD) of the part where the “violation” is registered , as well as about permits for them. Furthermore, on the 10th day after receiving the “letter of luck”, we will send a registered letter to the body that issued the decision on the fine, a complaint demanding the cancellation – based on the non-compliance with the sign with GOST , also attached here is a copy of the request about KSODD.
If the “authority” does not cancel the decision on the fine, we write a corresponding request to the court. By then there should already have been an official response regarding the legality of posting the sign(s). We also add it to the notice of appeal to the court. If violations are found, Themis will quickly cancel the fine.
